Terms of Service (Snack 4 Less)

These Terms of Service (“Terms”) govern your access to and use of the Snack 4 Less website and any purchases made through it (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1) Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Service and place orders. By using the Service, you represent that you meet this requirement.

2) Store Policies

Purchases and order issues are governed by our posted policies, including our Return & Refund Policy, which is incorporated into these Terms by reference.

3) Orders and Acceptance

By placing an order, you make an offer to purchase items subject to these Terms. Snack 4 Less may accept, reject, cancel, or limit orders at its discretion, including for reasons such as:

• inventory limits or stock errors

• suspected fraud or unauthorized activity

• pricing or listing errors

• violations of these Terms

4) Pricing and Product Information

We try to display accurate product descriptions, images, pricing, and availability. However, errors can happen. Snack 4 Less reserves the right to:

• correct any errors or omissions at any time

• change prices and availability without notice

• cancel orders affected by errors (including after an order is submitted)

Product packaging and images may vary due to manufacturer updates.

5) Payments

You agree that:

• you are authorized to use the payment method provided

• your billing and shipping information is accurate and complete

• you will pay all charges incurred through your order

If your payment is declined or reversed, we may cancel the order or suspend fulfillment.

6) Shipping, Delivery, and Risk of Loss

Shipping and delivery timelines are estimates and not guarantees. Once an order is shipped:

• carrier delays and service disruptions are outside our control

• you are responsible for providing a correct shipping address

• risk of loss and title pass to you when the shipment is handed to the carrier, unless otherwise required by law

If tracking shows “delivered,” the order is considered delivered.

7) Cancellations and Changes

We process orders quickly. You may request a cancellation or change, but it is not guaranteed.

• once an order is processed or shipped, it cannot be canceled or changed

8) Promotions and Discount Codes

Promotions and discount codes:

• have no cash value

• may be limited, modified, or discontinued at any time

• must be applied at checkout (no retroactive adjustments)

• may be restricted to one per order and may exclude certain items

9) Accounts (If You Create One)

If you create an account, you are responsible for all activity under it and for keeping your login credentials secure. Snack 4 Less may suspend or terminate accounts for suspected fraud, abuse, or violations of these Terms.

10) Prohibited Conduct

You agree not to:

• use the Service for unlawful purposes

• attempt to disrupt or damage the website or systems

• scrape, crawl, reverse engineer, or bypass security measures

• submit false information

• abuse refunds, replacements, or disputes

Snack 4 Less may restrict access, cancel orders, or block users for violations.

11) Intellectual Property

All content on the Service (including text, images, logos, design elements, and software) is owned by or licensed to Snack 4 Less and protected by applicable laws. You may not use, reproduce, or distribute it without permission, except for personal, non-commercial use.

12) Third-Party Links

The Service may contain links to third-party sites. Snack 4 Less is not responsible for third-party content, policies, or practices. Use third-party sites at your own risk.

13) Disclaimers

To the fullest extent permitted by law, the Service and products are provided “as is” and “as available.” We do not guarantee uninterrupted access or that the website will be error-free.

14) Limitation of Liability

To the fullest extent permitted by law, Snack 4 Less will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits.

Snack 4 Less’s total liability for any claim will not exceed the amount you paid for the specific order giving rise to the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15) Indemnification

You agree to indemnify and hold Snack 4 Less harmless from claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your infringement of any rights of a third party.

16) Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.

Any dispute must be brought in the state or federal courts located in Miami-Dade County, Florida, unless otherwise required by law.

17) Changes to These Terms

Snack 4 Less may update these Terms at any time. The “Last updated” date above reflects the most recent version. Continued use of the Service after updates means you accept the revised Terms.

18) Electronic Notices

You agree that we may provide notices and communications electronically, including via the website, checkout flow, or order status pages.

19) Severability

If any part of these Terms is found unenforceable, the remaining sections will remain in effect.

20) Entire Agreement

These Terms, together with any posted store policies (including the Return & Refund Policy), form the entire agreement between you and Snack 4 Less regarding the Service.
